CLAIMS NO CLAIMS AFTER INSTALLATION. INSTALLATION
We don’t warranty the color
Because all stones of ACT Stone are natural and handmade products, their colors and shape vary, thereby, ACT Stone under no circumstance will be liable for variation of shade and color between tiles, and the samples.
Acceptance
Any questions and claims about the color, quality, or design of the stones must be resolved 30 days after the delivery and before installation.
NO WARRANTY AS TO QUANTITY ESTIMATES
ACT Stone under no circumstance is liable for the number of Stones ordered. The customer is responsible for estimating the quantity and matching the additional Stones.
Availability
All items sold by ACT Stones; Inc. are subject availability at the time of shipping. If a certain item is not available, we reserve the right to offer an alternate material with prior notification and notice to the buyer.
Normal wear; grout
Over time, on all tile surfaces, some starching and crazing may occur. ACT Stone will suggest you select a matching color of the grout, and pay attention to use grout release before grouting.
Delivery terms
ACT Stone is not responsible for damages that happen during shipment, the buyer has 5 days since receiving the Stone, to send their claim to the shipping company and also send a copy to ACT Stone. It is also buyers’ responsibility to arrange for unloading, and ACT Stones is not responsible for any damage that may happen during unloading and our carriers do not provide inside delivery.
Sample shipments
Sample shipment charges are for single samples only. If you order more than 2 samples of the same item, there will be packing charges assessed. We are not responsible for damaged tiles via shipping companies.
FORCE MAJEURE
ACT Stones, Inc. will not be held accountable for any delay in delivery or suspension or cancellation of performance or other failures of performance mentioned in this document due to any causes beyond its control, for example, acts of God or government, labor disputes, or inability to secure materials, labor or transportation and so on. If any delay happens due to these reasons, ACT Stones, Inc.’s time for delivery or other performance will be extended for a period equal to the duration of such delay.
Assignment
This agreement is not assignable by purchaser without ACT Stones, Inc.’ prior written consent. Any attempt to assign any rights, duties or obligations hereunder without ACT Stones, Inc. written consent shall be void.
CONFLICT OF TERMS
It is agreed that sales are made on the terms, conditions and warranties contained herein. To the extent of any conflict, these terms and conditions take precedence over any on buyer’s order form. No agreement altering, modifying or extending the terms of this agreement shall be valid unless in writing, duly signed by the parties.
- To stop water stains, you must choose a moisture thin-set for all white marble, all limestone, and Cement products.
- It is suggested to open all boxes and lay all the materials so the customer can see and approve.
- Because of all the cuts and waste, it is recommended to buy 10% more for regular cuts and 30%more for diagonal cuts.
- Since our products are natural stones, their characteristics, colors, and patterns are different in each shipment.
- If you need more than one box of a product, you should mix the boxes to make sure your customer approves of the color and the pattern.
- If later on, you order new boxes of material, it is on you to make sure it matches the material you ordered before.
- You must use grout release or sealer before grouting.
- To stop expansion and contraction, you should leave a 1/8” joint in all of your installations.
- Because our stones are natural, there may be some imperfections in the stones, such as pits, holes, fill, etc. which is the characteristic of natural stones.
